4.0 Brief Introduction:

Open Two tendering is procurement process where generally tenders are invited in two bids wherein technical and price bids are submitted and tender document includes pre-qualification criteria in technical bid and prices are submitted in price bids.

4.1 Background:

MDL Tender was published for requirement of Blasting and painting of units / blocks fabricated at MDL. The published Tender was initially extended, then scrapped and re-tendered the same requirement because of following reasons:

i. Defective BOQ (i.e. some line items were missing & repeated in BOQ) was uploaded on e-procurement site along with Tender.

ii. The pre-qualification criteria were not in line with SoW.

Based on the complaint received from one of the bidders, investigation was carried out. During investigation, following lapses were observed:

i. a) Estimation range was not correctly indicated in proposal, b) while forwarding documents for TNC, Tender ID was incorrectly indicated on proposal for scraping and re-tendering, c) PBG percentage was incorrectly indicated, d) WDC clause was incorrectly indicated in Tender, e) the payment terms were not properly indicated in Tender. Some of the above lapses were repeated while re-tendering.

ii. Corresponding email was not forwarded to correct addresses because of which proper communication was not done and Cost Estimation could not be received on time resulting into delay in Tender opening.

iii. The mistakes committed by Dealing Commercial Executive was not detected by recommending as well as approval authority at the respective stages of processing the proposals.

4.2 Implementation:

Based on the investigation, following systemic improvements have been suggested and requested for implementation:

i. HOD of respective commercial dept. to sensitize all the Executives of his Dept. on the remedial actions to avoid repetition of similar lapses in the future. Need based training in specific areas (Commercial, Finance etc.) to be arranged imparted to the Executives for enhancement of skill/knowledge.

ii. Before recommending/approving any proposal/draft Tender, recommending/approving authority shall review the content of proposals thoroughly.

4.3 Impact and Benefits:

Implementation of the aforesaid systemic improvements will mitigate repeated mistakes committed by Dealing Commercial Executives. Recommending/approving authority shall become more careful while recommending/approving any proposals. Need based training, will enhance the skill/knowledge of Dealing Commercial Executives.
